Experience

Mr. Zhang graduated from Southwest University of Politics and Law in 2012 and obtained the Doctor Degree in IP law. His main research fields include IP litigation injunction, compensation for damages and online infringement. Mr. Zhang has published dozens of articles on intellectual property theory in Law Journal, Intellectual Property Law Journal, Hebei Law Journal and other academic journals successively with reasonable knowledge structure and solid theoretical foundation.

 

Mr. Zhang has been engaged in intellectual property theoretical research and judicial practice for 20 years. Before joining Beijing W&H (Guangzhou) Law Firm as a senior partner, Mr. Zhang worked for the intellectual property tribunals of the Foshan Intermediate People's Court and the Guangdong Higher People's Court, and was engaged in intellectual property trials for ten years. He tried more than 1,000 cases of various intellectual property disputes as a judge, and many of these cases were selected as the ten most typical intellectual property protection cases in Guangdong province or in China.

 

 

Mr. Zhang has extensive experience in the judicial practice of intellectual property, and is experienced in applying for and registering intellectual property, managing intellectual property risks, evaluating the value of intellectual property, transferring and licensing intellectual property, as well as intellectual property administration and judicial protection. In particular, he is adept at comprehensively applying various relief procedures to handle disputes involving intellectual property infringement.

 

Mr. Zhang mainly engages in IP legal services and provides IP litigation and non-litigation legal services to well-known domestic and overseas enterprises and public institutions, such as Qualcomm, Alibaba Group, NetEase, Daphne, Midea, Zhenkongfu, and the Guangdong Institute of Ecological Environment Technology.

Classic-Cases

In 2015-2016, acted for Daphne International Holdings, Ltd. in the case against  Guangzhou Daphne Shoes Co., Ltd. over the trademark infringement and unfair competition disputes. The court of second instance ruled that the infringer shall stop the infringement and compensate for economic losses of CNY5.5 million.

In 2016, acted for NetEase (Hangzhou) Network Co., Ltd. in the case of the pre-trial injunction dispute over copyright and unfair competition, against Beijing Shenzhou Taiqi Interactive Technology Co., Ltd. and Guangzhou Dynamic Computer Technology Co., Ltd., the court issued the injunction within one week to immediately stop the pending infringement.

In 2016-2017, acted for the Tianxia (Beijing) Information Technology Co., Ltd. to handle the dispute arising from the unauthorized use of special name series of well-known commodity against Shenzhen Weibian Technology Development Co., Ltd., claiming a compensation of CNY60 million, which successfully obtained the compensation of CNY10 million and greatly protected the commercial interests of customers.

In 2017-2018, acted for Beijing Sankuai Technology Co., Ltd. (“Meituan Network”) in the case against Shanghai Lazas Information Technology Co., Ltd. (“Hungry Away”) in a series of 4 unfair competition disputes, all of which won.

In 2018-2018, acted for Shenzhen Rice Technology Co., Ltd. in the case against Wuhan Yuanguang Technology Co., Ltd. in disputes over the crime of illegally obtaining data in a computer information system and unfair competition, winning all criminal and civil cases. The case of unfair competition dispute was selected as one of the top ten intellectual property right judicial protection cases in Guangdong in 2018.

In 2017-2019, acted for Guangdong Midea Refrigeration Equipment Co., Ltd. in the case against Ningbo Oxbow Air Conditioning Co., Ltd. in 4 utility model patent infringement cases and 9 invention patent infringement cases; acted for Guangdong Midea Refrigeration Equipment Co., Ltd. in the case against Zhuhai Gree Electric Appliances Co., Ltd. in 2 utility model patent infringement cases; All the above 15 cases were won.

In 2017-2018, acted for Guangdong Midea Refrigeration Equipment Co., Ltd. in the case against Zhuhai Gree Electric Appliances Co., Ltd. regarding to unfair competition disputes which he finally won and was selected as one of the top ten cases involving the judicial protection of intellectual property rights in Foshan in 2018. More than 1.7 million people watched live court trials on the network platform;

In 2018-2019, acted for Qualcomm Incorporated in the case against Apple Computer Trading (Shanghai) Co., Ltd. in a dispute over the infringement upon patent for invention.
